Welcome to DevourNow ("we," "our," or "us"). We are committed to protecting your privacy and ensuring you have a positive experience on our website and with our services. This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you visit our website or use our services.

If you use Family Club, the Family Club Privacy Policy Addendum also applies and describes additional information we collect and share as part of that service.

2. Information We Collect

We may collect information about you in a variety of ways. The information we may collect on the Site includes:

  • Personal Data: Personally identifiable information, such as your name, shipping address, email address, and telephone number, that you voluntarily give to us when you register with the Site or when you choose to participate in various activities related to the Site.
  • Derivative Data: Information our servers automatically collect when you access the Site, such as your IP address, your browser type, your operating system, your access times, and the pages you have viewed directly before and after accessing the Site.

3. Information Specific to Family Club

3.1 Information We Collect for Family Club

If you join Family Club, we collect and use some additional information beyond what's described above, to run the weekly subscription itself:

  • Household and delivery information: Your delivery address, household size, and weekly meal selections, so we can match you to the local restaurant kitchens covering your address and generate your weekly order.
  • Dietary and allergen information: Any allergies or dietary preferences you choose to tell us about. We use this only to route your order correctly and to print it on your delivery labels - not for marketing or any other purpose.
  • Payment information: Family Club payments are processed by Stripe, our third-party payment processor. We do not store your full card number ourselves; Stripe handles that under its own privacy and security practices.

3.2 Sharing Your Information With Restaurant Partners

Each week, we share the order and preference information a restaurant partner actually needs to prepare your meals - your meal selections, portion count, and any allergens or dietary notes you've given us - with whichever restaurant is cooking for your household that week. Restaurant partners may use this information only to prepare and fulfill that week's order, and are not permitted to use it for their own marketing or to contact you directly outside of fulfilling your order.

3.3 Text Message (SMS) Communications

If you opt in to text messages from Family Club, we may text you about your weekly order, upcoming cutoffs, delivery status, or promotions. Message and data rates may apply. You can opt out at any time by replying STOP, or get help by replying HELP. We won't send marketing texts before 8:00 a.m. or after 8:00 p.m. in your local time zone. See Section 4 for how consent and opting out work.

4. Approve Messages (Legal Consent)

To comply with federal TCPA regulations, CTIA carrier standards, and CAN-SPAM laws, we send marketing text messages only to people who have agreed to receive them, and we give every recipient of our texts and emails a simple way to stop.

Text messages (SMS)

  • How you consent: You agree to receive text messages from DevourNow by checking an unchecked consent box on one of our forms, texting a keyword to our number, or giving us written consent in another documented way. We keep a record of when, where, and how you gave consent.
  • Not a condition of purchase: You don't have to agree to marketing texts to buy from us, join Family Club, or become a restaurant partner.
  • Who we text: Customers and Family Club members, and restaurant owners and staff who have opted in to hear about DevourNow services and Family Club partnerships.
  • What we send: Order and delivery updates, cutoff reminders, account notices, and promotions or partnership offers. Message frequency varies.
  • Costs: Message and data rates may apply. Carriers are not liable for delayed or undelivered messages.
  • Opting out: Reply STOP, END, CANCEL, QUIT, UNSUBSCRIBE, REVOKE, or OPT OUT at any time. You can also opt out by any other reasonable means, such as telling us by email or phone. We honor opt-outs promptly and no later than 10 business days, and may send one message confirming your opt-out.
  • Help: Reply HELP, email support@devournow.com, or call (617) 848-3921.
  • Timing: We won't send marketing texts before 8:00 a.m. or after 8:00 p.m. in your local time zone.

Email

  • Every marketing email we send identifies DevourNow as the sender, includes our physical mailing address, and contains an unsubscribe link.
  • We process unsubscribe requests within 10 business days.
  • After you unsubscribe from marketing email, we may still send transactional and account messages, such as order confirmations, receipts, and service notices.

Your mobile information

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support services, such as customer service, is permitted. All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Use of Your Information

Having accurate information about you permits us to provide you with a smooth, efficient, and customized experience. Specifically, we may use information collected about you via the Site to:

  • Create and manage your account.
  • Process your orders and payments.
  • Email you regarding your account or order.
  • Fulfill and manage purchases, orders, payments, and other transactions related to the Site.
  • Generate a personal profile about you to make future visits to the Site more personalized.

6. Disclosure of Your Information

We may share information we have collected about you in certain situations. Your information may be disclosed as follows:

Mobile phone numbers and text message consent are never shared for marketing purposes; see Section 4.
